Emby constantly changing my refresh rate (even when disabled)

I am using the new Emby Theatre app from the MS store ->

And I have every option turned off (see attached) giving Emby permission to change my display refresh rate but EVERY time I start playing any kind of content my refresh rate is either changed to 23.96/24/29.97 or 50hz. Completely randomly, even the same content can/will use a diff refresh rate as I've been testing it. Also, the hamburger menu only goes up to 60hz and I can't set it to 165hz.

This is super aggravating and I am not sure why Emby continues to do this when it's disabled.
