Just hoping someone can shed some light onto why/what is going on with my playback on DLNA.

Setup; Fresh Emby server running on an old Asus EP121 board on Windows, wanting to use it for DLNA to different TV's on the network only, not wanting to use Andriod apps etc... just basic DLNA to the TV. I was hoping that any files that the TV's don't recognise would be transcoded by Emby (I do realise the board I'm using is rather lacking in power, but with GPU and CPU I was thinking it would handle one file easily).

All setup and running, I go to my first TV, select Family Guy S01E01, doesn't work, the TV shows an incorrect format error, along with other seasons which display the same error, I am assuming this is because it's an AVI, all MP4 files work fine. Not wanting to convert all the AVI to MP4's I was thinking emby would transcode these? Am I wrong in assuming it would if it's going via DLNA?

AVI is  (or at least should be) a dead format. Use Handbrake or something like it to get the files involved into a format that is actually primarily supported by modern hardware. It may take a little time but it can be done as an automated process, in the background and/or at night. If you do that, problem solved.

As an alternative get decent hardware to run  you server and do whatever necessary to not use DLNA which is also (or should be) a dead protocol. Just about any other choice would be better.

I actually wish Emby would remove DLNA support. While DLNA can be turned off in Emby the code still exists and Emby developers must support it and thereby waste time that could be better spent on just about anything else.

In spite of popular belief DLNA did not really coexist with the T-Rex but it did come into existence about the time people began walking upright. Just about anything else is better, a LOT better.

I'm going to start the conversion from AVI to MP4 with Avidemux, simple and easy to do batch process, just didn't fancy doing it for 10 seasons of Family Guy. 

The idea for this setup is for our second home, we use two different bedrooms to sleep in and we like watching Family Guy/Simpsons/American Dad at night and I don't want to keep using/transferring a memory stick between two different TV's, mainly because they are both wall mounted out of reach without standing on a chair, so I figured I can just use some old hardware I have lying around to put it to use, I was just hoping Emby would transcode these files instead of converting them all myself.

DLNA in itself does seem rather outdated and 'simple' compared to today's standards of media offerings, but it does serve a purpose :)

Yes. It's primary purpose is to add to confusion and clutter on message boards. I actually have no idea why it is still being used at all. Devices that do the job well and use modern protocols are VERY cheap now so it is unnecessary to continue to use it even for devices, like televisions, that have it built in. It was unreliable and poorly supported when it came into existence and it has not become better with age.
