playback stops with hardware transcoding enabled - no issues with hardware turned off

We tried a few things and narrowed down the problem to AVC/h.264 encoding.

HEVC decoding is fine but whenever either intel or nvidia HW is used this pausing issue happens.
Disabling the Intel adapter made no difference.
Remuxing source files from mp4 to mkv (rewrite headers) made no difference

For now we left it using software avc encoding so it's functional.
@twalker294 is going to look at a couple of other things and update the thread later.

Well guess what? I uninstalled everything that I had installed that had to do with video encoding (codecs, utilities, etc,) and now it's working like a charm. Carlo thanks SO MUCH for your help and sorry I wasted your time. Emby is the best!

Very nice.  Yes I won't uninstall things like that to not be involved in breaking any other software being used.
But I'm glad you did it and now it works!

Do you know exactly what it was you uninstalled to get it working?  Codec pack or something like that?

I should have kept a list of what I uninstalled. Avidemux was one, Fairlight Studio Utility (from Blackmagic, part of Davinci Resolve,) Apowermirror, adblink, and maybe one or two more. Sorry I didn't keep a list!

I have Avidemux installed on a few systems so it likely wasn't that one.
If you care to figure it out (up to you) just install one app at a time until it breaks again. :)
