"Downloading Subtitles" message does not go away

Hi All, my Apple TV is displaying "Downloading Subtitles" in white letters across a film I am streaming from my home server. If I switch of subtitles than I do not get the forced substitles for foreign language parts.

 

Can anyone shed any light on how I can get forced substitles working without having "Downloading Subtitles" splashed across my TV!!

Hi.  How long have you waited for it to go away?

 

If you re-play that same item a second time, do the subs work then?

Probably about 4 mins before I stop it.
