Chocolate Theme Legacy view/show recent item backdrops conflict

Not sure if this is meant to happen, but when I turn "Use Legacy Folder Browsing" off and turn "Show recent items Backdrops" on, it doesn't show the backdrops. But if I turn legacy folder browsing on. The recent items backdrops starts working.

 

I have 5 folders of different content. Most are movies apart from one folder of TV. The TV folder works when legacy browsing is turned off and recent item backdrops is on. but none of the other folder do.

 

Any help would be great.
