Skip intro getting stuck

I'm having a problem where the skip intro button is sticking and remaining visible through TV series. I've turned it off but obviously that's not great more a work around than a fix. Anyone else? And any ideas?

It's definitely a video/metadata issue only does it on the last 3 episodes of a certain series hasn't done it since...
