What background setting do you prefer?

As a photographer, I prefer quality photography with no graphic illustration.  If it is a scene from the film, then it is the preferred image created by the director and cinematographer... so 1.

Until recently I was sure that 1.
In recent days I think 2 is the best.
I also noticed that all the streaming services use a designed background image

Remember that as a background those are going to get much darker. There is no way #2 could even be considered a background without some kind of background shade thrown over the top to color/darken it. Emby apps already do apply that background shade.

My point being you should also show these images with a black rectangle over the top of them with a soft gradient from transparent to black. The black should start at bottom and go up to at least 30% from the bottom then soft gradient to transparent from there on up the other 70%. The top transparent entirely line shouldn't be more than a few pixels tall. Then call that your background shade. Now change the opacity on it to somewhere between 45% and 65%. Lay that over your background image. Then you can pretty much see how they will look inside Emby applications.

I think the images are just examples for the different styles, I doubt he wanted it to be exactly as it would be shown in Emby.

The preference would be on 1 in that case since it right justifies. Since the character art (interesting part) of the backdrop would survive having things thrown on the top of the image on detail screens. On the image in 2 it is centered.

On Emby detail screens they tend to gobble up the left side of the screen towards the bottom edge with overlays of text and such when dealing with Movies. That makes the art on 1 near perfect for this display. The only part of the background obscured by those images/text would be some floor and railing. The rest of the background would show through.

With 2 the art is centered entirely. It would look good on a TV Season screen. Since the TV Season screen only obscure the bottom edge of the background on Emby detail screens. But as a Movie it is going to get treated with that left oriented display wall of stuff near the bottom. The left/bottom half of that image is going to get eaten away. If you were to adjust the image in 2 to instead of centering be pushed more towards the right side it would work on details screen perfectly. There would then be an even contest between 1 and 2.

That is the problem with your 2 images. The main character (interesting part) is in different position in both images.

If this were a question of which position should the interesting part be placed in? It would be 1. The problem with backgrounds is people have to enable them. Then people have to acquire them. Then they have to find some actually look good with the way Emby presents them. Not backgrounds that look good by themselves. But look good after Emby has laid whatever over the top of them.

If you are going to frame these and hang them on your wall as landscape artwork inside picture frames they can be any way you like them as they aren't having anything laid over the top. It all depends on the purpose of the background.

I do not care what background there is. I watch content not the interface.
In fact I think I prefer Emby with no background at all but I rarely even notice it so I do not know if I have turned all the fluff off everywhere. I do turn it off if I notice it.
