Live TV -- Lagging out shuddering during commercials only.

This happens only during some commercials breaks. Assuming it is a bitrate change or going from mpeg 4 to 2. Doesn't seem like any of the betas so far have addressed this. I am using HD Homerun Prime tuners with cable card. Happy to share logs but first wondering if anyone else is experiencing this? I watch CNBC during the day and see this quite often and while it happens I can fast forward and skip the lag and it will return to live TV without issue, if I don't it can stay in a perpetual lag.
