Android TV App Stuttering/no Pass through Atmos

Hi Guys long time user, been using the Emby App on my Shield for ages no issues like this thus far, 

 

Lately the app has been a stuttering mess with 4k files or anything with Atmos it won't pass through to my AVR, also even a 480p/720p video file will take 30+ seconds of the spinning blue circle to start

So I installed MrMC and signed into my Emby server and everything works perfectly, 

 

I have reset the shield, reinstalled emby server (Windows 10) and this issue still continues and is baffling me any help would be much appreciated, what logs would you like to see,
